Legal basis
Why Spindory’s service is legal under U.S. law.
Spindory buys genuine, lawfully made books from legitimate retailers. We do not reproduce, reprint, or scan any copyrighted content. We only alter the physical binding of the books we own — replacing the spine with a spiral coil, hinged lay-flat mechanism, or hardcover conversion. We then resell those exact same physical copies with clear disclosure that Spindory performed only the rebinding. The original authors and publishers retain full rights to the content.
This is a protected resale under the U.S. First Sale Doctrine, supported by Supreme Court precedent for modified genuine goods with truthful labeling.
The statutes
- 17 U.S.C. § 109 — the First Sale Doctrine. The owner of a lawfully made copy of a copyrighted work may sell or otherwise dispose of that particular copy without the copyright owner’s permission.
- 15 U.S.C. § 1125 — the Lanham Act. Prohibits false or misleading designation of origin. We comply by disclosing clearly that Spindory performed only the rebinding and that the original authorship is unchanged.
The precedent
- Prestonettes v. Coty, 264 U.S. 359 (1924) — repackaging or modifying genuine goods is permitted so long as the labeling is truthful about what was done.
- Champion Spark Plug Co. v. Sanders, 331 U.S. 125 (1947) — reselling repaired or refurbished genuine goods is permitted so long as the consumer is not deceived about the origin or the nature of the modifications.
What this means for Spindory
Taken together, the statute and the precedent confirm that Spindory may buy a book, rebind it, and resell it — provided that (a) the original copy was lawfully purchased, (b) the physical modifications are disclosed, and (c) the original authorship and publisher are never misrepresented. That is exactly the standard we hold ourselves to.
